These General Terms and Conditions apply to all offers, orders, agreements, and deliveries of products by Effendy – Selection Exclusive, a registered brand of Telesto Group B.V. By placing an order, you agree to these terms. These terms have been extended to comply with both Dutch and international e-commerce laws, with specific provisions for premium coffee, delights, and equipment sales.

1. General
- Effendy – Selection Exclusive is a registered brand of Telesto Group B.V., registered under EUIPO No 018734426, WIPO No WO0000001705806, and BOIP No 1460547.
- These Terms and Conditions apply to all offers, orders, agreements, and deliveries of products by Effendy and are accessible on the Telesto website. A written copy can be provided upon request.
- By placing an order, the customer agrees to these Terms and Conditions.
- Telesto reserves the right to amend these Terms and Conditions after the expiry of the agreed term.
- Unless otherwise agreed in writing, the general or specific conditions of third parties are not recognized by Telesto.
- Telesto guarantees that the delivered product meets the agreement and the specifications stated in the offer.
EU Consumer Rights Note: These terms comply with the EU Consumer Rights Directive (2011/83/EU) as implemented in Dutch law, which provides strong consumer protection for all EU customers. Under this directive, we are required to provide clear, comprehensive information about our products and services before purchase.
2. Offers and Agreements
- All offers are non-binding and subject to availability.
- An agreement is established when Effendy confirms an order in writing or commences execution.
- Effendy reserves the right to refuse orders without stating reasons.
- In accordance with the EU E-Commerce Directive (2000/31/EC), we will provide electronic confirmation of your order without undue delay.
- For orders placed through our website, the contract is not considered finalized until we have sent confirmation of the order via email.
3. Prices and Payment
- All prices are in euros and exclude VAT, shipping costs, and other applicable fees unless stated otherwise.
- Prices remain unchanged throughout the offer duration unless legal measures or manufacturer price increases require adjustments.
- Payments must be made within the agreed term and in the manner specified by Effendy.
- In case of late payment, the customer is in default without further notice, and Effendy is entitled to charge interest and collection costs.
- For Dutch customers, the standard VAT rate of 21% applies to most products, while certain food products may qualify for the reduced rate of 9% in accordance with Dutch VAT law (Wet op de omzetbelasting 1968).
- For EU customers outside the Netherlands, we apply the VAT rules of your country of residence in accordance with EU VAT regulations for e-commerce (as of July 1, 2021).
- For customers outside the EU, local import duties, taxes, and customs clearance fees may apply and are the responsibility of the customer.
4. Delivery and Risk
- Delivery is subject to stock availability.
- Delivery times are indicative and not binding; no rights can be derived from them.
- Under distance selling regulations, orders will be executed within 30 days unless otherwise notified. If delivery is delayed beyond this, the customer has the right to cancel without costs.
- The delivery obligation is fulfilled once the product has been offered to the customer. In case of refusal, the carrier’s report serves as proof of delivery attempt.
- The risk of loss or damage transfers to the customer upon delivery.
- If a delivery is delayed due to customer-related circumstances, Effendy may charge additional costs.
- For international deliveries, we comply with all relevant customs regulations and provide necessary documentation for smooth customs clearance.
- For perishable coffee products and delights, we use appropriate packaging to maintain product quality during transit, in compliance with EU food safety regulations.
5. Retention of Title
- All delivered products remain the property of Effendy until full payment has been received.
- The customer may not pledge, resell, or dispose of the products before ownership transfers.
- This retention of title is valid in all EU member states in accordance with EU Directive 2011/7/EU on combating late payment in commercial transactions.
6. Right of Withdrawal and Returns
- If the purchase qualifies as a consumer purchase under Dutch law, the customer has the right to return the products within 14 working days without stating reasons. This period starts upon delivery.
- The customer must notify Effendy of the return within 14 working days and provide proof of return shipment.
- Returns must be in original packaging, including all accessories, and in unused condition. Used, damaged, or altered products are not eligible for return.
- Effendy will refund the purchase price, including shipping costs, within 14 days of receiving the return, provided the return conditions are met. Return shipping costs are borne by the customer.
- In accordance with the EU Consumer Rights Directive (2011/83/EU), the right of withdrawal does not apply to:
- Services already initiated with the customer’s consent.
- Products subject to market price fluctuations.
- Perishable goods or items that cannot be returned due to their nature, including opened coffee beans, ground coffee, and food products.
- Products where the seal has been broken.
- Orders delivered outside the EU (returns accepted, but Telesto’s incurred shipping costs are non-refundable).
- For customers outside the EU, we honor the 14-day return policy where possible, subject to international shipping constraints and local regulations.
EU Withdrawal Right: The 14-day withdrawal period is a mandatory right for EU consumers under the Consumer Rights Directive. This right allows you to cancel your order for any reason without penalty. To exercise this right, you must inform us of your decision to withdraw before the 14-day period expires.
7. Complaints and Warranty
- The customer must inspect products upon receipt and report any defects within 48 hours.
- Effendy guarantees that products meet the agreement, specifications, usability, and legal requirements.
- If a justified complaint is made, Effendy may replace the product or provide a refund.
- Any additional warranties from the manufacturer do not affect the legal rights of the consumer.
- In accordance with EU Consumer Sales Directive (1999/44/EC) and Dutch law (Burgerlijk Wetboek, Book 7), consumers have a legal warranty period of two years for non-perishable products.
- For coffee equipment, we provide warranty information specific to each product, which will be included with the product documentation.
- For food products, we guarantee compliance with all applicable food safety regulations and quality standards at the time of delivery.
8. Liability
- Effendy is not liable for indirect damages, including consequential loss, lost profits, or business interruption.
- Effendy’s liability is limited to the invoice amount of the delivered products.
- The customer indemnifies Effendy against third-party claims arising from product use.
- Nothing in these terms limits our liability for death or personal injury caused by our negligence or for any matter for which it would be illegal for us to exclude or attempt to exclude our liability.
- For coffee brewing equipment, we provide safety instructions and warnings. Customers must follow these instructions to ensure safe use.
9. Data Management and Privacy
- Customer data is stored in Telesto’s customer database and processed in accordance with the General Data Protection Regulation (GDPR).
- Telesto respects user privacy and ensures confidentiality of personal data.
- Customers may unsubscribe from mailing lists following the instructions in each mailing.
- For detailed information on how we process your personal data, please refer to our Privacy Policy.
- We use cookies and similar technologies on our website in compliance with the EU ePrivacy Directive (2002/58/EC) as amended by Directive 2009/136/EC.
10. Force Majeure
- Effendy is not liable for delays or non-performance due to force majeure, including but not limited to natural disasters, strikes, supplier failures, or government actions.
- In case of force majeure, Effendy has the right to suspend or dissolve the agreement without liability.
- For coffee products specifically, force majeure may include crop failures, shipping delays, or other disruptions in the global coffee supply chain that are beyond our control.
11. Intellectual Property
- All intellectual property rights to Effendy’s products, branding, and materials remain with Effendy or its licensors.
- The customer may not reproduce, distribute, or use Effendy’s intellectual property without prior written consent.
- Product descriptions, images, and content on our website are protected by copyright and may not be used without permission.
12. Food Safety and Product Regulations
- All food products sold by Effendy comply with the EU General Food Law Regulation (EC) No 178/2002 and the Dutch Commodities Act (Warenwet).
- Our coffee products comply with all applicable EU food safety standards and regulations, including:
- Regulation (EU) No 1169/2011 on the provision of food information to consumers
- Regulation (EC) No 852/2004 on the hygiene of foodstuffs
- Regulation (EC) No 396/2005 on maximum residue levels of pesticides
- For organic coffee products, we comply with EU Organic Regulation (EU) 2018/848.
- All coffee equipment sold complies with relevant EU product safety directives, including the Low Voltage Directive (2014/35/EU) and Electromagnetic Compatibility Directive (2014/30/EU) where applicable.
- We maintain a food safety management system based on HACCP (Hazard Analysis and Critical Control Points) principles for all food products.
- Product labels provide all legally required information, including ingredients, allergens, nutritional information, and storage instructions where applicable.
Food Safety Compliance: As a seller of food products, we comply with the Dutch Commodities Act (Warenwet) and EU food safety regulations. All our coffee products meet strict quality and safety standards, and we maintain full traceability throughout our supply chain in accordance with EU General Food Law requirements.
13. International Sales and Cross-Border Regulations
- For sales within the EU, we comply with all relevant EU regulations on cross-border e-commerce, including the Geo-blocking Regulation (EU) 2018/302.
- For sales outside the EU, customers are responsible for compliance with local import regulations, customs duties, and taxes.
- We provide accurate customs information for all international shipments to facilitate smooth customs clearance.
- For coffee products shipped internationally, we comply with all relevant phytosanitary regulations and provide necessary documentation.
- International customers may be subject to different consumer protection laws depending on their country of residence. Where mandatory local consumer protection laws provide greater protection than these terms, those local laws will prevail.
- For EU customers, the following VAT rules apply in accordance with EU VAT e-commerce regulations:
- For orders below €150, VAT is charged at the rate applicable in the customer’s country of residence
- For orders above €150, VAT is charged based on the destination country’s rules
14. Sustainable Sourcing and Certifications
- Effendy is committed to sustainable and ethical sourcing of coffee and related products.
- Where products carry certification labels (such as Fairtrade, Rainforest Alliance, or organic), these certifications are verified and documented.
- We comply with EU timber regulations (Regulation (EU) No 995/2010) for any wooden products or packaging.
- Information about the origin, certification, and sustainability aspects of our coffee products is provided on product pages and packaging.
- Claims regarding sustainability, organic status, or other certifications are made in compliance with EU regulations on environmental claims and unfair commercial practices (Directive 2005/29/EC).
15. Governing Law and Disputes
- These Terms and Conditions are governed by the laws of the Netherlands.
- Any disputes shall be submitted to the competent court in the Netherlands.
- For EU consumers, this choice of law does not deprive you of the protection afforded by provisions that cannot be derogated from by agreement by virtue of the law of your country of residence.
- In accordance with the EU Alternative Dispute Resolution Directive (2013/11/EU), EU consumers may also use the European Commission’s Online Dispute Resolution platform (http://ec.europa.eu/odr) to resolve disputes.
- We strive to resolve any complaints or disputes amicably. Please contact our customer service team at the contact details provided on our website before initiating any formal dispute resolution process.
Legal Jurisdiction: While these terms are governed by Dutch law, EU consumers retain the protection of mandatory consumer protection laws in their country of residence, in accordance with Article 6(2) of the Rome I Regulation (EC) No 593/2008 on the law applicable to contractual obligations.
